Consumer Health Data Privacy Policy

Additional protections for consumer health data under state law.

Several U.S. states — including Washington (My Health My Data Act), Nevada, and Connecticut — require a separate disclosure specifically about “consumer health data,” distinct from HIPAA and our general Privacy Policy. This page provides that disclosure. It applies alongside, not instead of, our HIPAA Notice of Privacy Practices, which governs the protected health information handled through the clinical system (PracticeQ) used by the licensed providers who evaluate your request.

What “Consumer Health Data” Means

Under these state laws, “consumer health data” generally means personal information that identifies a consumer’s past, present, or future physical or mental health status — reasonably linkable to you, and not otherwise covered by HIPAA when it’s held outside a HIPAA-covered clinical system.

Categories We Collect

  • Information you provide when selecting a concern category or describing why you’re seeking care, before that information becomes part of your protected clinical record;
  • Your state/location, used to confirm you’re in an area where a licensed provider can treat you;
  • Whether you have an active, pending, or completed visit request; and
  • Any health-adjacent information you voluntarily share with us outside of an actual clinical visit — for example, in a customer support message.

Once you begin a clinical visit, your intake and clinical information become protected health information governed by our HIPAA Notice, not this policy.

How We Use Consumer Health Data

We use consumer health data only to:

  • Route you to the right concern category and connect you with a licensed provider;
  • Confirm you’re located in a state where we can legally offer you care;
  • Operate, maintain, and improve the Family Rx service; and
  • Respond to your questions or support requests.

We Do Not Sell Consumer Health Data

We do not sell your consumer health data, and we do not use it for targeted advertising. This matches our general commitment in our Privacy Policy not to use health information to personalize marketing or share it with advertising partners.

Retention

We retain consumer health data only as long as necessary for the purposes described above, or as required by applicable law, and then delete or de-identify it.

Your Rights

Depending on where you live, you have the right to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data;
  • Access the consumer health data we hold about you;
  • Delete your consumer health data;
  • Withdraw consent to our collection or sharing of your consumer health data, at any time; and
  • Appeal a denial of any of the above requests.

To exercise any of these rights, email support@solunaone.com with the subject line “Consumer Health Data Request.” If we deny your request, we will explain why and tell you how to appeal; you may reply to that response with the subject line “Consumer Health Data Appeal.” We will not discriminate against you for exercising these rights.
